Terms of Service

These Terms of Service ("Terms") govern your use of Collector HQ (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian. You must comply with all applicable laws and with the terms of any third-party platform you connect (including eBay's own User Agreement).

2. Your Account

You're responsible for keeping your account credentials secure. Notify us immediately at support@collector-hq.com if you suspect unauthorized access. You're responsible for all activity that occurs under your account.

3. The Service

Collector HQ provides tools for card collectors: portfolio tracking, set browsing, saved eBay searches, scheduled bidding ("snipes"), and research tools. Features are described on our marketing pages and may be added, modified, or removed over time.

4. eBay Integration & Sniping

To use sniping and watchlist features, you must connect your eBay account via OAuth. By doing so, you authorize Collector HQ to use the access tokens eBay provides to place bids and read listing data on your behalf, strictly within the scope of the features you use.

You are the bidder. When you schedule a snipe, you authorize Collector HQ to attempt to place a bid up to your specified maximum at the scheduled time. You are the bidder of record. Once a bid is placed and accepted by eBay, it forms a contract between you and the seller under eBay's User Agreement, regardless of whether the snipe wins.

Cancellation.You may cancel a scheduled snipe at any time before its fire time. Once a bid has been placed with eBay, retraction is governed by eBay's bid retraction policies, not ours.

No guarantee.We do our best to fire snipes at the requested time, but we don't and cannot guarantee that any snipe will be placed successfully or will win the auction. Factors outside our control include:

• eBay API outages or rate limiting.
• Network latency between our servers and eBay's.
• Other bidders entering competing bids.
• Listings ending early, being modified, or being cancelled by the seller.
• Your eBay account losing the ability to bid (e.g., a hold or suspension by eBay).

We are not liable for missed snipes, lost auctions, network failures, or any costs arising from any of the above.

5. Acceptable Use

You agree not to:

• Use the Service to violate eBay's User Agreement or any applicable law.
• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to scrape, harvest, or redistribute data we provide.
• Use the Service in a way that harms or disrupts other users, our infrastructure, or third-party platforms.
• Misrepresent your identity or impersonate another person.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual Property

All Service software, design, and content (excluding user-submitted content) is owned by Collector HQ and protected by applicable copyright and trademark laws. You retain ownership of any content you submit (saved searches, collection notes, etc.) and grant us a limited license to host and display it so we can operate the Service for you.

7. Third-Party Services

The Service integrates with third-party platforms (eBay, Supabase, Vercel, Cloudflare, Upstash, and others). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the availability or content of third-party services.

8. Affiliate Programs & Disclosure

Collector HQ participates in the eBay Partner Network and other affiliate programs. We may earn a commission on certain outbound clicks that result in qualifying purchases. We never affiliate-tag links involved in automated bidding (snipes). All affiliate links are disclosed in compliance with FTC guidelines.

9. Fees

The core Service is currently free. Paid features may be introduced; we'll give you advance notice and the option to decline before any charges. You're responsible for any taxes applicable to your purchases.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COLLECTOR HQ AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOST AUCTIONS — ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) $100, OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Collector HQ and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Termination

You may disconnect your eBay account from Settings at any time, and you may delete your full account by contacting support@collector-hq.com.

We may suspend or terminate your account for violation of these Terms, suspected abuse, or where required by law. We'll typically give notice unless doing so would compromise security or another user's interests.

14. Modifications

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in California.
